Dalton Eatherly, the controversial livestreamer known online as ChudTheBuilder, has been released from jail after securing bonds in two Tennessee counties, but he will remain under house arrest with strict limits on his movement and public statements.

The Montgomery County Jail confirmed Eatherly’s release after nearly three months in custody. A spokesperson for the Nashville District Attorney’s Office subsequently told WSMV that he had posted both his $1 million Montgomery County bond and a separate $15,000 Davidson County bond.

Eatherly had been in custody since May 13, when he was charged with attempted murder following a shooting outside the Montgomery County Courthouse. He is also charged with employing a firearm during a dangerous felony, aggravated assault, and reckless endangerment with a deadly weapon.

Four days before the shooting, Eatherly was arrested following an alleged dispute at a Nashville restaurant. Prosecutors accused him of refusing to pay a $371.55 bill after staff asked him to stop livestreaming and leave the business.

Nashville case adds stricter rules to ChudTheBuilder’s release

Eatherly was initially released on a combined $5,000 bond in the Nashville cases, which include theft of services under $1,000, disorderly conduct, and resisting arrest. That bond was revoked in June after the Montgomery County charges were filed.

Following an August 6 hearing, Davidson County Judge Cynthia Chappell set a new bond of $5,000 for each offense, totaling $15,000, and imposed several additional conditions.

The signed order requires Eatherly to remain under house arrest at his Montgomery County residence. He cannot possess any weapons, must remain GPS monitored, and is prohibited from entering Davidson County except for scheduled court appearances. He is also barred from applying for a passport and must surrender any passport already in his possession.

The order also prohibits Eatherly from publicly discussing the facts, evidence, witnesses, or his guilt or innocence in the Nashville restaurant case through posts, livestreams, interviews, or other public communications.

That is separate from an earlier Montgomery County gag order restricting what he can say about the courthouse shooting. The Montgomery order permits general assertions of innocence and discussion of information already in the public record, meaning neither order is a blanket ban on all social media activity.

The Nashville case therefore directly affects Eatherly’s release.

Montgomery County had previously imposed a 9 p.m. to 5 a.m. curfew, but the newer Davidson County order requires full house arrest. Because he has posted bonds in both counties, he must comply with both sets of conditions while the cases move through their respective grand juries.
